1. Acceptance of Terms
By downloading, installing, or using Recall, you agree to these Terms of Service. If you do not agree, do not use the app.
Recall is distributed through the Apple App Store. Apple’s Standard End User License Agreement applies to your licensed use of the app unless Apple or App Store Connect applies a different agreement. These Terms supplement that license for Recall’s services, subscriptions, AI processing, user content, and support.
2. What Recall Is and Is Not
Recall is a customer-memory productivity tool for sales and relationship-driven professionals. It helps you capture and find sales-relevant customer context from your own notes and conversations.
Recall is not:
- An employer CRM, DMS, LMS, LOS, EHR, EMR, policy administration system, legal matter-management system, or official system of record
- A medical-record system, HIPAA system, patient chart, or repository for protected health information
- A loan-origination, underwriting, credit-decision, insurance-rating, legal-advice, medical-advice, or regulated-decision platform
- A document vault, password manager, credential store, or compliance archive
- A replacement for your employer’s required systems, record-retention policies, customer notices, or compliance workflows
You are responsible for ensuring your use of Recall complies with your employer’s policies and applicable laws.
3. Your Responsibilities
Authorized use: You represent that you are recording notes about customer interactions you participated in directly, using information you are authorized to record in the course of your professional duties.
No unauthorized imports: You agree not to upload, import, scrape, export, or duplicate data from employer systems, customer databases, CRMs, DMSs, EHRs, LOSs, policy systems, or other restricted systems unless you have authorization.
No sensitive or regulated payloads: You agree not to enter, upload, record, or store sensitive information that is unnecessary for sales follow-up, including Social Security numbers, driver-license numbers, credit-card or bank details, passwords, credentials, access codes, full credit reports, full loan applications, tax returns, PHI, patient identifiers, diagnosis/treatment details, privileged legal advice, legal strategy, signed regulated documents, or confidential security materials.
Review before relying: You are responsible for reviewing AI-generated transcriptions, summaries, extractions, search results, and suggested profile updates before relying on them.
Professional judgment: Recall assists memory and organization. It does not provide legal, medical, financial, credit, underwriting, insurance, tax, employment, or compliance advice.
4. Medical Sales and Health Data
Recall is not intended to receive, store, or manage protected health information or patient records. Unless a separate written agreement says otherwise, Recall is not acting as a HIPAA Business Associate.
Medical sales users must not store patient names, MRNs, patient identifiers, diagnosis details, treatment details, lab results, medical images, insurance member IDs, patient billing details, or other PHI in Recall. Use required healthcare, hospital, employer, or vendor-approved systems for regulated health information.
5. AI and Transcription
Recall uses AI services and a Recall AI proxy to process recordings and notes for transcription, structured extraction, and search support. By using these features, you authorize transmission of submitted content for those processing purposes.
AI-generated content may be inaccurate, incomplete, or unsuitable for a particular business or compliance purpose. You are responsible for editing, correcting, deleting, or declining any AI-generated output.
6. Customer Book Backup and Account Recovery
Customer Book Backup is optional. If you enable it with Sign in with Apple, Recall may create a recovery session and store a latest backup snapshot of eligible customer-book data so you can restore an empty install.
Customer Book Backup is backup/restore, not multi-device sync. It does not replace your responsibility to export, retain, delete, or protect customer information according to your employer policies and applicable law.
You are responsible for maintaining access to the Apple ID you use for recovery. If you delete the recovery account and backup from Settings, Recall will delete the cloud backup and clear the recovery session on that device, but local customer data on the device remains until you delete it, delete the app, wipe the device, or use available local deletion controls.
Recall does not guarantee that backup or restore will always be available, complete, current, or error-free. You should keep your own authorized exports or records when your work requires independent retention.
7. Subscription and Payment
Recall is offered on a subscription basis. Current pricing is displayed in the App Store.
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
- Manage or cancel subscriptions in your Apple ID account settings
- Refunds are handled by Apple and applicable law
- We may change pricing or plan features. Price increases for auto-renewing subscriptions will be communicated through Apple’s required subscription notice and consent flow before taking effect.
8. Ownership and License
Recall and its software, design, prompts, models, documentation, and related materials are owned by Joseph Cornaggia or its licensors and protected by law. You receive a limited, non-exclusive, non-transferable license to use the app for personal professional productivity.
You retain ownership of content you create. You grant Recall the limited rights necessary to process submitted content to provide the app’s features, including transcription, structured extraction, search support, storage on your device, export, and related functionality.
9. Privacy and Data Use
Recall’s data practices are described in the Privacy Policy. Recall does not sell individual customer records or use customer notes for targeted advertising.
You are responsible for obtaining any notices, consents, permissions, or employer approvals required for the information you choose to record, store, process, or export through Recall.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Recall is provided “as is” and “as available” without warranties of any kind
- We do not warrant that AI outputs will be accurate, complete, compliant, available, or error-free
- We are not liable for lost data, missed follow-ups, incorrect notes, business losses, compliance failures, customer disputes, employment consequences, or decisions made using AI-generated content
- Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100 if you paid nothing, unless applicable law requires otherwise
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
11. Force Majeure
Recall is not liable for delays, interruptions, or failures caused by events outside its reasonable control, including third-party provider outages, Apple App Store or payment-system disruptions, network failures, security incidents outside Recall’s control, natural disasters, labor disruptions, government actions, or other force majeure events.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold Joseph Cornaggia harmless from claims, damages, losses, liabilities, and expenses, including legal fees, arising from: (a) your content entered into Recall, including any defamation, privacy violation, intellectual-property infringement, or unauthorized disclosure; (b) your violation of these Terms, including the prohibitions on sensitive or regulated data; or (c) your violation of applicable law, customer rights, or employer policy.
13. Termination
We may suspend or terminate access if you violate these Terms or use Recall in a way that creates legal, security, or operational risk. You may stop using Recall by cancelling your subscription and deleting the app. Local data remains on your device until you delete it, delete the app, wipe the device, or use available deletion controls.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Sacramento County, California, unless applicable law requires a different forum.
Recall may disclose information when required by law, valid legal process, or necessary to protect the security, rights, and safety of Recall, users, or others.
Informal resolution first: Before filing a claim, you agree to contact us at legal@recallforsales.com and attempt informal resolution.
15. Changes to Terms
We may update these Terms. Material changes will be communicated where legally required. Continued use after the effective date means you accept the updated Terms.
